General Promotion Terms and Conditions

• This promotion is only for publishers that have (i) registered for the promotion via a link provided by Kontera or its authorized agent and (ii) agreed to an In-Text Service Order and its accompanying Terms (together the “In-Text Agreement”), which are hereby incorporated by reference into these General Promotion Terms and Conditions (“Promotional Terms”). Any term not defined herein shall have the meaning set forth in the In-Text Agreement. If there is any direct conflict between a term of the Promotional Terms and a term of the In-Text Agreement, with respect to issues relating to any promotion, the Promotional Terms shall prevail.
  
  
• Each eligible publisher may only receive one Promotional Payment regardless of the number of Publisher Websites that utilize the ContentLink Service or anything else. The identity of a publisher will be determined on the basis of all or any combination of the following: name, mailing address, e-mail address, IP address, computer, and any other forms of identification which may be required. Kontera and/or its authorized agent may, in its sole discretion, determine any publisher’s the eligibility to participate in Kontera promotions.
  
  
• Kontera reserves the right to modify, alter, discontinue or terminate a promotion at any time for any reason whatsoever without notice to publishers, using reasonable efforts to provide such notice in advance.
  
  
• Kontera and/or its authorized agent shall not be liable for any damages howsoever arising as a result of any such modification, alteration, discontinuance or termination of any promotion, and any such liability shall be borne solely and exclusively by end users.
  
  
• Promotions shall only be valid in the calendar month or other period (as applicable) in which they are advertised to be valid
  
  
• Kontera and/or its authorized agent reserve the right to review transaction records and logs, from time to time, for any reason whatsoever. If, upon such review, it appears that the publisher or any one or combination of them are participating in strategies which Kontera and/or its authorized agent in their sole discretion deem to be abusive, Kontera and/or its authorized agent reserve the right to revoke the entitlement of such Publisher to the promotion.
  
  
• In the event of a dispute, the decision of Kontera will be considered final.
